Last Tuesday night, April 1, вЂњPrisoners DaughterвЂќ Rona, вЂњTrue BlueвЂќ Atenean Robi and вЂњBubbly GirlвЂќ Jieriel were given the opportunity to march alongside their proud parents -- Mommy Rose, Daddy Boy, and Daddy Gerry. The other teen housemates were also present during the ceremony and so were Pinoy Big Brother Teen Edition Plus host Bianca Gonzalez, PBBTE1 2nd Big Placer Mikee Lee, and representatives from the three graduates respective schools. And like any other graduation ceremony, diplomas and honors were given to the graduates. Jieriel from Davao got a CAT Award while Robi from Quezon City was given his 2nd honors medal from Ateneo High School. The Court of Appeals' chief undermined the court's Rules Committee, which issued an opinion that did not confirm to his, in the ongoing controversy over the Meralco case, additional letters obtained by abs-cbnnews.com/Newsbreak show.

These letters are from the chairman of the CA's Rules Committee, Justice Edgardo Cruz, who noted that his June 19 letter—where he issued a decision on the controversial and high-profile Manila Electric Co. case—was snubbed by CA's Presiding Justice Conrado Vasquez, Jr.

In another letter, dated August 4, Cruz reminded Vasquez about this decision and attached other correspondences prior to the June 23 oral argument on the Meralco case. Cruz also copy furnished Supreme Court Chief Justice Reynato Puno since Cruz said these June letters were not included in the documents that Vasquez submitted to the Supreme Court after the July 31 CA en banc meeting where they discussed the Meralco case.

It was Vasquez, in fact, who asked Cruz to rule on the rift over who among the squabbling divisions should handle the Meralco case. But when Cruz made a decision, in favor of Justice Bienvenido Reys of the 9th Division, Vasquez ignored it.

In an earlier story, we attributed Vasquez's behavior to weak leadership. He allowed the rift among the justice to continue when he could have stood by the Rules Committee decision. We also reported that he appeared to have undue interest in the case since his two daughters work with GSIS, a party to the case.

Cruzs letter came two days before a Supreme Court panel was to start its investigation on the propriety of the appellate justices' actions.

Cruz wrote, Under the situation, it is essential that the Supreme Court must have a complete picture of the case, particularly on what precipitated my opinion.

Had Vasquez heeded Cruz's opinion on the handling of the Meralco case in June, the rift among the appellate justices who were involved in the Meralco case would have not built up in the past two months and reached the current state where the Supreme Court had to intervene in the hope of salvaging the CA's integrity.

Unsolicited advice?

Cruz wrote the August 4 letter since he wanted to clarify impressions on his participation in the case.

Earlier, Justice Jose Sabio Jr., who acted as chairman of the old 9th division that originally handled the Meralco case, mentioned Cruz in his documentation of the Meralco-related events to Vasquez. Sabio referred to Cruz as a junior justice who was only rendering a personal opinion over the issue of who should preside over the oral argument in June 23.

Cruz wrote, Justice Sabio's letter tends to create the impression that I intruded into his dispute with Justice Reyes and gave an unsolicited advice thereon.

Cruz wanted to highlight that his opinion was not personal nor was it unsolicited by attaching copies of the correspondences with Reyes, who was the designated chairman of the old 9th division.

Reyes, in his letter dated June 19, a Thursday, wanted to clarify with the Rules Committee, which Cruz chairs, who between him and Sabio should preside over the oral argument which was scheduled for June 23, the following Monday.

In his letter, Reyes noted that There is now a dilemma as to whom the case should be properly given, whether to Justice Sabio, Jr. or to me…The case is scheduled for hearing on 23 and 24 June 2008. It is therefore necessary to resolve the issues raised herein before the hearing.

Reyes was on leave when the Meralco case was raffled to the 9th division, which he chairs, but was back to work by June 16, seven days before the scheduled oral argument.

More worthy to note, however, is the copy of Vasquez's letter to Cruz on June 20, a Friday, where the former was even endorsing Reyes's letter.

Vasquezs endorsement letter to Cruz said: Attached herewith is the letter of Justice Bienvenido L. Reyes seeking your opinion regarding an IRCA interpretation in the case. There is some urgency involved as the hearing of the case is on Monday, June 23, 2008.

Not exempted

Cruz wrote back also on June 20 that Reyes should chair the oral argument.

He responded that while Sabio acted as the chair of the old 9th division that issued the Temporary Restraining Order in May, the issuance of a TRO is not among the instances where 'the justices who participated' in the case share 'remain' therein.

In other words, the TRO, which favored the Lopez family and their allies who were in a legal battle with another Meralco shareholder, the government through the Government Service Insurance System , is not among the exemptions in the CA's internal rules which was exactly what the Rules Committee was interpreting.
Accounts over what transpired between June 20 and right before the June 23 oral argument as documented in the correspondences submitted to the Supreme Court showed that Vasquez ignored Cruz's opinion. Instead, he gave his personal opinion favoring Sabio.

Earlier, Sabio sought Vasquez's opinion after getting a copy of Cruz's verdict. He called up Vasquez and mentioned that he smelled something fishy, considered Cruz's opinion as a personal opinion, and wondered why the matter was not openly and deliberately discussed with .

Instead, before the June 23 oral argument on the Meralco case, Sabio called Justice Martin Villarama whom he considered as more senior and experienced than Cruz, and sought his opinion on who should preside that morning.

Villarama then advised Sabio that his stand—based on chairing the division that issued the TRO as a reason to hold on to the case—was correct. He informed Vasquez that Villarama then told him that he should remain in this case.

It seemed that Vasquez allowed Sabio's and Villarama's opinion to reign over that of the Cruz's of the Rules Committee. Vasquez's July 24 letter to Reyes and Justice Vicente Roxas, the case's ponente, explained why.

Vasquez wrote: My personal opinion on the matter, for whatever worth it may be, is that the Division that issued the temporary restraining order should continue resolving the injunctive prayer in the petition…

Vasquez reasoned that before the oral argument, GSIS had a pending motion to lift the TRO so Sabio who headed the 9th division that issued it should continue handling the case.

Rules Committee sidelined

By July 4, the issue of the Meralco case evolved from who among the justices to what division should handle it. Vasquez himself implemented the mandated reorganization at the CA, which resulted in the transfer of Roxas to the new 8th division. The internal rules say that the Meralco case should be handled by the division wherever Roxas is since he is the case's ponente.

Even with the reorganization, Vasquez still held the opinion that since Sabio already presided over the Oral Argument in June 23 where there was a pending motion to replace the 60-day TRO with a more permanent preliminary injunction, Sabio and the former 9th division should continue handling the case.

One month after and with more wrangling among the justices involved in the Meralco case, the new 8th division issued on July 24 not a preliminary injunction but a decision, which favored the Lopezes and their allies.

All throughout July and in the run up to the 8th division's issuance of their decision, the Rules Committee's opinion in June was already sidelined.

The Rules Committee was not tapped again, since according to Vasquez in his July 28 letter to all the 65 CA justices, Some intervening events and novel situations, which I believe are not covered by our internal Rules… has prompted him to call for the en banc meeting last July 31 where it was decided that the Supreme Court should already step in.

Cruz, however, had to call the attention of the Supreme Court before the assigned panel starts their investigation to inform them of his committee's position early on.

NEW YORK - Rafael Nadal, in his first grand slam as the number one target, took his turn at shooting down one of the big-hitting young guns at the U.S. Open on Monday to ride into the quarter-finals at Flushing Meadows.

The Spaniard, the top-seeded world number one for the first time at a major, had to dodge a bevy of bullets from 20-year-old American Sam Querrey, before blazing to a 6-2 5-7 7-6 6-3 win.

Querrey blasted in 20 aces and 52 winners before succumbing to Nadal after three hours, 13 minutes of crunching hits.

When the dust cleared on a windy day at Arthur Ashe Stadium, Nadal had matched his best Open showing by reaching the last eight against unseeded American Mardy Fish, who beat 32nd seed Gael Monfils of France 7-5 6-2 6-2.

China Bank to raise P8B from long-term deposit certificates

China Banking Corp., which is partly owned by conglomerate SM Investments Corp., said Thursday its board has approved the issuance of long-term negotiable certificates of time deposit worth up to P8 billion.
In a letter to the stock exchange, the bank said it would issue the LTNCD in one or more tranches and subject to the central bank's approval.
"The planned LTNCD issuance will expand the issuer's long-term deposit base and support the bank's long-term asset growth," it said.
China Bank also declared a 20-percent or P20 per share cash dividend and a 15-percent stock dividend to shareholders. Record and payment dates have yet to be announced.
Its board also approved the increase in its authorized capital stock from P16 billion to P20 billion.

Fitch: RP bank system improved but challenges ahead

SINGAPORE - Fitch Ratings on Tuesday commented that while operating fundamentals of the Philippine banking system have improved over the past four to five years thanks to the progress in resolution of NPLs, improved capitalisation and enhanced regulation, it nevertheless continues to be weak owing to a volatile operating environment and the lack of a sustainable earning assets profile.

The agency noted that despite the recent improvements, the Philippine economy remains weak due to limited fiscal flexibility, high inflation and persistent political uncertainty.

In a special report on the Philippine banking system to be published soon, Fitch noted that a salient feature of the Philippine banking system has been the historically weak demand for bank credit .

This could be attributed to the dominance of the services sector and to a lesser extent the agrarian sector, which require relatively less investment outlay as well as limited activity in the consumer banking space.

Even though banks have recorded higher lending growth over the last two years, the agency believes this momentum may not be sustainable due to the more challenging operating environment in the future. As such, a rather high 25% of the banking system assets are allocated as investments, mostly in government debt securities, which has resulted in the banking system depending on trading income.

However, the agency observes that such dependence in the present rising interest rate environment could erode the banks' earnings through lower trading gains and possibly even actual or mark to market losses.

Since the implementation of the Special Purpose Vehicle Act in 2002, the system's gross non-performing assets /total assets ratio improved to 5.9% at end-2007 from 13.2% at end-2002. The SPV Act, which expired in May 2008, facilitated the reduction in NPLs, but had a lesser impact on reducing foreclosed properties.

Due to the current less benign economic environment, the resolution of foreclosed properties is likely to remain slow and loan quality may even start to somewhat deteriorate although NPLs were well reserved at 80% at end-2007.

The capitalisation levels in the system provide moderate support for the Philippine banks to weather the higher operating-environment related risk. The various types of capital instruments, which were raised since 2006 have helped to preserve the capital adequacy ratios against the negative impact of Basel II accord, which was adopted in July 2007.

The Philippine banks have presently adopted the standardised approach for credit risk and the basic indicator approach for operational risk.

While the Philippine banking system consists of 847 banks, including more than 700 rural & cooperative banks, the core of the banking system is formed by 38 universal and commercial banks that account for 87% of the system assets, with the top three banks accounting for nearly 33% of the system assets.

Following the consolidation among some of the larger banks over the past few years, ownership concentration has increased with some large private banks being majority-owned by Filipino business families with other significant business interests.

While such ownership concentration could lead to conflicts of interest and is potentially a concern, Fitch notes that standards of corporate governance in the Philippines have somewhat improved over the years, albeit at a gradual pace.

The Philippine Star Basketball association executive director Noli Eala and PBA commissioner Sonny Barrios meet again on Monday to iron out minor kinks in the SBP-PBA partnership for the formation of the RP team to the 2009 FIBA Asia championship in China.
Barrios will discuss with Eala the package of assistance the PBA could give the SBP on its short-term program for the national team.
"Of course, two parties must first come to an agreement. Were not demanding and were open to suggestions. Id like to believe we would iron out whatever kinks there might be," said Barrios.
"The PBA has made its stand public. The two parties are likely to have a joint official statement as soon as they come to an agreement," Barrios added.
The PBA board has approved taking responsibility in forming the team but left the task of looking for sponsors, which will bankroll the training of the team, to the SBP.
Barrios said the PBA also intends to have the sole authority in naming the national coach. The overwhelming majority of PBA officials are for Red Bull mentor Yeng Guiao.
"Well pursue the position arrived at by the board," said Barrios.
Since the league wont finance the training, the PBA top honcho said they would welcome a finance officer disbursing the funds of the would-be sponsor.
"I would volunteer not to be the one disbursing the budget. I would leave it to them. It would be the call of the sponsors or the SBP. Its fine with us," said Barrios.
Either San Miguel Corp. or Smart/PLDT is likely to be tapped to sponsor the team.
SMC reportedly spent around P40 million in financing coach Chot Reyes program for the Tokushima Olympic qualifier last year. Apparently, the expenses overshot the budget and the PBA had to shoulder some using the league revenue.
If thats a concern, a league official said the would-be coach should be told to just work within the budget.

LOS ANGELES - Los Angeles Angels pitcher Francisco Rodriguez broke a Major League single-season record when he posted his 58th save in a 5-2 win over the Seattle Mariners on Saturday.

Rodriguez, a 26-year-old right-hander from Venezuela, bettered the Major League mark set by the Chicago White Sox's Bobby Thigpen in 1990 and tied by Rodriguez on Thursday.

He pitched the final inning, striking out the final two batters with runners on second and third base.

A lot of people back home have been rooting for me to break the record, Rodriguez told the MLB website . It's very important for my people, my country, to get that record.

Rodriguez, who began his Major League career in 2002, now has 204 career saves.

He's fearless, Angels manager Mike Scioscia told reporters. I've been around a lot of good closers, but Frankie turns the page better than anyone I've seen.

He's been as consistent as any pitcher I've seen. This has really been a magical year for Frankie, but he's been great his whole career.

GAZA CITY - As most of the rest of the Islamic world welcomes Ramadan with festive treats and family get-togethers, Palestinians in the Gaza Strip wearily brace for another holiday under a crippling blockade.

Israel has sealed off the impoverished territory from all but basic goods since the Islamist Hamas movement seized power in June 2007, and it is during the holidays that weary residents say they feel the sanctions the most.

Honestly, I don't even feel like we welcome Ramadan, because year after year things go from bad to worse, with life becoming harder and more expensive, says Dina, a university student shopping in a Gaza City market.

The Muslim holy month during which the faithful fast from sunup to sundown is normally a festive time of lavish nightly feasts, holiday treats, and family reunions -- all of which have become harder for most Gazans to afford.

The Israeli sanctions on Gaza after the bloody Hamas takeover coupled with the rise in world prices have resulted in widespread shortages and sent food and fuel costs soaring.

Ramadan this year is like any other month, because you don't see any of the things that make it special, says Mohammed Abu Sultan, a father of four shopping for decorative Ramadan lanterns.

Every year I buy my children lanterns but I was shocked this year because the price has almost doubled, he said, adding that his family is cutting back on holiday treats and even limiting their cooking to conserve fuel.

Others are resorting to more creative alternatives.

My father went to get me a lantern in the market but did not find one this Ramadan, says Ahmed, a nine-year-old boy. I'm going to have to make one out of a cardboard box and put a candle in it.

Israel has kept the sanctions in place despite a two-month-old truce with Palestinian militants which has mostly halted rocket fire on southern Israel in a bid to keep pressure on Hamas, which the West considers a terrorist group.

The blockade, along with rising world food and fuel prices, has forced Gaza families who muddled through past Ramadans to cut more corners, even limiting family visits because of the cost of fuel and public transportation.

People who would normally buy ten packages of Qamreddin will not buy a single package this year, says Majid al-Safdi, a local merchant.

The economic situation for people in Gaza has gone from bad to worse. Israel is treating us in a shameful way because it only allows us to import a small amount of those things that are special to Ramadan, he says.

Israel has raised the number of trucks carrying food and basic goods it allows into Gaza over the past month to over 180 trucks a day, both because of Ramadan and the start of the new school year.

The amount of cattle that have been going in have been increasing over the past week, and we also have been facilitating the delivery of sweets and candies, Israeli military spokesman Peter Lerner told AFP.

The shortages remain however, and consumers say profiteers have taken advantage of the situation, smuggling goods in through a vast network of tunnels between Gaza and Egypt and selling them at exorbitant prices.

Some of these traders did not have anything until very recently, Dina, the university student says. Now you find all kinds of things but the prices are unimaginable. It's harvest time for these people, and we are the victims.

Mahmud Aud, another merchant, says there has been an insane rise in the price of basic goods both because of the world economy and the closures.

As an example he cites coconuts, which sold for less than two dollars a kilogramme last year but are now around six dollars .

Even small price increases can have a dramatic effect on Gaza, where over 60 percent of the territory's 1.5 million residents live in poverty and a majority rely on international food aid, according to the United Nations.

The Israeli closures have also decimated Gaza's private sector, forcing the vast majority of its factories to shut down or drastically scale back operations and paralysing the local construction industry.

But they seem to have had little impact on their intended target, Hamas, which more than a year into the siege remains Gaza's unchallenged rulers.

EL ALTO, Bolivia - Muttering incantations at a witches' market above La Paz, Faustino Tinta sets fire to a dried llama fetus and wax trinkets, an offering his client hopes will help Bolivian President Evo Morales survive a recall vote.

Tinta, 53, is one of dozens of witch doctors who tend a warren of stalls in the Morales' stronghold of El Alto, making offerings that promise luck at work or in love, or to call up spirits and banish curses.

Inside his stall herbs hang on the wall next to a carving of Jesus and a picture of Morales. Outside, at around 13,120 feet above sea level, snow falls on the ground.

Snow. It is a happy omen, he said, sprinkling alcohol on the palms of 23-year-old miner Javier Ramos. Many people have come to make offerings to Pachamama for Evo.

August is the month of Pachamama, or Mother Earth, central to Andean culture.

Ramos wants spirits to protect him while he works underground at a gold mine in the town of Consata, 85 miles north of La Paz, and to ensure that Morales wins Sunday's vote and pushes on with his nationalization and pro-poor reforms.

I'm making this offering so things go well at work, so that nothing happens to me inside the mine, so I make money, and so that Evo wins, he said, his smile revealing tiny gold stars set into his teeth as the smell of caramel wafted from the burning pyre. I will vote for him. Let's hope he wins.

Political crisis

Morales is expected to survive a recall vote this weekend but South America's poorest country is gripped by a political crisis that could deepen as right-wing opponents seek to derail his socialist reforms.

Morales and eight of Bolivia's nine provincial governors face Sunday's recall votes. Confident of victory, he approved the votes in an apparent bid to undermine his opponents and sap momentum from autonomy movements in natural gas-rich eastern provinces.

The president is very popular in and around La Paz, but his reforms, from energy and mining nationalization to the centralization of energy revenues, have polarized Bolivians.

Evo is going to have the support of more people. He is going to win the referendum, said soothsayer Maria Samo, tossing coca leaves onto a crucifix placed on a piece of woven material in her own stall nearby.

But his enemies will try to make trouble. There, look: that is his luck, added Samo, pointing to two stray leaves, their dark green upper side facing upwards. She has told fortunes for 25 years and followed in her grandmother's footsteps.

I am planning on attending the Adobe Max Conference in San Fran next month. I checked out their site and its pretty cool. If you click in the background you can explore the little island in the back. They have a simon game where you follow the pattern, but instead of the 4 color lights you have cacti. They make a sound and change color. Then they have this monster on the ice section. Anyways I thought is was a cool idea.

The national abstinence clearinghouse, and American organisation committed to promoting abstinence education, held a very inspiring and motivating conference for 900 attendees in Rosen Shingle Creek Resort and Conference centre from the 22-25th July. The theme of this year’s conference was ‘gather active minds and watch them grow.’ Some of the best speakers from around the country gathered to bring together new information, network, encourage others, teach new skills and exchange products and services. Leslee Unruh, the founder and President of the NAC, reminded the attendees, “As you educate today’s youth, you are inspiring and guiding them as they become the next generation of leaders.”

This year’s conference saw a youth track and a Spanish set of talks in action for the first time. The organisers noted that the message does not change but the carriers of the message do. Abstinence educators were described as life changers, leaders and role models for the next generation, helping young people to save sex until marriage. One of the first plenary speakers was Doctor Tom Lickona who reflected on the ten emotional dangers of pre marital sex. Kim Cernovsek talked about the medical arguments for abstinence from the perspective of a dermatologist. The overwhelming prevalence of the HPV virus was frequently mentioned as well as strategies to increase awareness and prevent transmission. Keith Deltano talked of the need for both comedy and evidence of effectiveness of abstinence education.

Many of the conference delegates where aware of the need to develop skills to be able to communicate well to teenagers: dance, comedy, theatre, music, stunning multimedia displays and rap were used to bring the message to save sex until marriage. The news of an extension to the title V fund, a federal funding program to promote abstinence, was warmly welcomed. Fundraising initiatives were discussed by Dan Morgan and Rob Siedlecki. Lakita Garth and Keith Deltano described how to bring a media message to websites popular with teenagers.

The conference also included an excellent new documentary for teenagers called ‘look before you leap.’ This is a creative drama and comedy using skydiving as a metaphor for sex in order to encourage healthy relationships. The conference culminated with a banquet, awards dinner and talent contest called abstinence idol to find the best entertainer. Overall, the conference was an impressive way for those working with young people to dream more, learn more, do more and become more.

Sofia
the cultural and administrative capital of Bulgaria is an ancient city becoming more and more international. This city of more than one million people has become a delightful gateway to an undeservedly little-known country.

The jumble of cultures and religions as well as the ethnic tolerance of the society is reflected by the capital city of Sofia. A short walk in the centre from the marketplace is the Byzantine Church of St. George, which itself sits atop the ruins of the Roman settlement here. Nearby is the Banya Bashi Mosque, the largest in Bulgaria. Around the corner is the Sofia Synagogue, the largest Sephardic Synagogue in Europe.

Near all of this are scattered dozens of cultural institutions – theaters, museums, universities, opera and concert halls that would welcome the SIETAR-ians and gladly give a home to their next congress.
