BOSTON - John Lennon's widow, Yoko Ono, made big strides on Wednesday in a legal feud over footage of the former Beatle smoking pot, writing songs and discussing putting the hallucinogenic drug LSD in President Richard Nixon's tea.
Ono is in a legal dispute to stop World Wide Video, a New England consortium of Beatles collectors, from releasing the black-and-white footage as a two-hour film titled "3 days in the life" about Lennon during a pivotal and turbulent time for the most celebrated band of the 1960s.
U.S. District Court Judge Rya Zobel in Boston ruled in favor of Ono in two counts in a case involving videotapes that Rolling Stone magazine has described as "awesome John Lennon footage you might never see."
The case is centered around who owns the nine hours of raw footage filmed weeks before the "Fab Four" broke up in 1970.
World Wide Video claims ownership of the videos and says it paid more than $1 million for them after legal costs and other expenses. Ono's lawyers say she purchased the tapes from World Wide through a Florida man.
After that, the case gets murky. World Wide asserts that the tapes were stolen and were sold to Ono illegally, and sued Ono for copyright infringement in a bid to publicly show them.
Zobel told the court that Ono did not do anything constituting infringement -- from performing copyrighted work publicly, or distributing or publicly displaying the videos.
"What the plaintiff suggests just doesn't fit," Zobel said. "It seems to me the defendant's motion is well taken because there was no infringement."
The judge also ruled World Wide waited too long to find out what happened to the stolen tapes. Ono registered the tapes in 2002, but World Wide claims they did not discover Ono had them until they received a letter from her lawyers last year.
"The statute of limitations bars the claim as well," Zobel said. "The circumstances here really favor the defendant, not the claimant."
World Wide's lawyer, Joseph Doyle, said the case was still pending and that the question of who ultimately owned the videotapes had not been resolved. The judge has yet to rule on several other aspects of the case, he added.
World Wide was set to premier the documentary last year at the private Berwick Academy in Maine but abruptly scrapped the screening after the school received a stop order from Ono's lawyers.
It said it bought 24 original videotapes and their copyrights in 2000 from Anthony Cox, Ono's husband before her marriage to Lennon in 1969. Cox shot the footage at Lennon's estate in England for a documentary he planned titled "Portrait."
The footage, recorded from February 8 to 11, 1970, shows Lennon composing two hits, "Remember" and "Mind Games," along with a candid discussion of his drug use and scenes that World Wide describes as "intimate and no-holds-barred."
World Wide says the footage also shows Lennon sitting in front of a teapot saying, "We should put LSD in a teapot for Richard Nixon," among other scenes of the Beatle smoking marijuana and going through a typical day.

BONN - A long round of talks on the trek towards a new global deal on climate change headed to a close on Friday, battered by criticism that progress was negligible.
The 12-day haggle under the 192-nation UN Framework Convention on Climate Change was the second since the accord in Bali, Indonesia, last December that set down a "roadmap" of negotiations for a new planetary treaty.
Officials said important ground had been cleared.
But they admitted to worries about how to meet the tightening schedule for wrapping up the most ambitious and complex environmental pact ever attempted in Copenhagen in December 2009.
"We now have a clear understanding among governments on what countries would ultimately like to see written into a long-term agreement to address climate change," UNFCCC Executive Secretary Yvo de Boer said.
"But with a little more than a year to go to Copenhagen, the challenge to come to that agreement remains daunting."
The treaty would take effect from the end of 2012, when the current provisions of the UNFCCC's Kyoto Protocol expire.
It would be a template for reining in greenhouse gases in the next decade, encourage the transfer of clean technology and provide financial help to poor countries likely to bear the brunt of climate change.
Delegates said progress was being mainly stymied by a who-goes-first question on concessions.
Developing nations say the responsibility for global warming lies historically with rich countries, who are best placed for tackling it.
So they want the rich nations to first come up with detailed proposals as to how they intended to reduce their greenhouse-gas emissions post-2012.
But many rich nations want to see how emerging giants such as China and India -- set to be the biggest sources of greenhouse gases in the decades to come -- intend to deal with their own fast-growing pollution.
Indian representative Chandrashekar Dasgupta deplored "the lack of any real progress" in Bonn and "a deafening silence" among industrialized countries, save the European Union.
The EU unilaterally plans to cut its carbon pollution by 20 percent by 2020 compared to a 1990 benchmark and has offered to deepen this to 30 percent if other major emitters follow suit.
"I do feel we need a completely new spirit of cooperation from here," said Harald Dovland, a Norwegian chairing this part of the haggle.
"If we continue in this mode of work, I fear we will not succeed in achieving the goals set in the work program."
The talks ranged over a sprawling array of issues, including caps on carbon gases, market incentives to help the cleanup, reforestation and help for vulnerable countries in the face of climate change.
Delegates said another brake was the US elections as countries awaited a successor to President George W. Bush, fiercely attacked for snubbing the Kyoto process.
Green groups fretted that real negotiations were being left to a meeting in Accra, Ghana, in August, to the year's-end ministerial-level conference in Poznan, Poland, and to the final negotiations in Copenhagen next year.
"We're under huge pressure now, there are only 18 months to go to Copenhagen, the agenda has never been bigger and the progress has never been slower," said Bill Hare of Greenpeace International.
He accused Australia, Canada, Japan and the United States of methodological nitpicking and procedural roadblocks.
"This UN process is in trouble, but it's in trouble because of the absence of the United States from the negotiation and because of the lack of leadership being shown by critical major emitting economies here from the rich world."
Separately, the Dutch Environmental Assessment Agency estimated China was now by far the world's biggest emitter of carbon dioxide , the principal greenhouse gas.
China's emissions of CO2 rose eight percent last year, placing its pollution "about 14 percent" higher than that of the United States, the agency said.
By some experts' yardsticks, worldwide emissions of carbon gases need to peak within the next seven to 10 years to have a chance of staving off massive climate damage, such as drought, floods, storms and rising sea levels that will affect millions of lives.

CHICAGO - Ringo Starr held a "peace and love" fest on a rainy Chicago sidewalk to mark his 68th birthday on Monday. "What could be wrong? Peace and Love. What a great birthday gift," the former Beatle said. "It's a happening."

The event, which had sparse advance publicity, drew about 200 people on both sides of a street outside the Hard Rock Hotel in Chicago.

Some got close enough to catch a glimpse of Starr, clad in black and wearing purple glasses, with his wife Barbara nearby. Some even snagged one or more of the frosted birthday cupcakes the hotel handed out after he went inside.

"I saw it in the paper, left my sister's house and came down here," said Joyce McDaniels, who was visiting from Winton, California. She emerged from the crowd holding a slightly mauled chocolate cupcake, but it was a secondary prize.

"I saw a Beatle. That's all I needed!" she said.

Starr, in the midst of a U.S. concert tour, had announced the event on his Web site, saying he had been asked in a recent interview what he wanted for his birthday and replied "just more peace and love."

He also said he hoped anyone who wanted to join him anywhere in the world would mark the day with a two-fingered peace sign at noon local time.

Starr missed the noon deadline himself by a couple of minutes but was greeted by cheers from the onlookers who then sang "Happy Birthday."

"Thanks for coming," Starr shouted back.

The Filipino community in Daly City is proud of the achievement of 17-year-old AV Herrera who recently graduated from secondary school with top honors. Herrera, who immigrated to US in 2005, finished as valedictorian of the Westmoor High School. Her 4.3 grade point average became her ticket to be accepted as a freshman in Harvard and Standford universities. Coach Louie Alas powered his line-up with speed in the fourth quarter as the Letran Knights overpowered the PCU Dolphins, 73-62, in the second game of the NCAA men's basketball tournament at the Cuneta Astrodome in Pasay City Friday.

In the end, however, the lack of defensive rebounds and free throw connections led to the downfall of Coach Joel Dualan's squad.

Jazul, last week's NCAA top player, ended another week on high note as was named best player of the game.

With the win, Letran came up in second place of the standings with a 3-0 win-loss slate.

The Dolphins, meanwhile, was further buried in the cellar with 4 losses in as many games.

Earlier in Game 1, the Cardinals of Mapua defeated the College of St. Benilde Blazers, 63-57.

Mapua remained on top of the standings with a 4-1 card while the Blazers went down to fourth at 2-3.

High school basketball player Keith Agovida of Jose Rizal Light Bombers unleashed a record-setting shooting binge never seen before in Philippine basketball as he scored 82 points in a 127-49 rout of Mapua Friday.

NCAA officials said the 18-year-old, 61 Agovida is now NCAA's highest scorer in over 80 years.

It is the highest in the league's history since Letran Squire Marlon Bola Bola dropped 71 in the '70s.

It is also the highest scoring output in the history of Philippine basketball since Allan The Triggerman Caidic torched the net with 79 points in 1987 in the professional basketball league.

Agovida, who scored 23, 13, 20 and 26 in the four quarters, also beat the second-highest scoring output in NBA history, Kobe Bryants 81.

NEW YORK - Green Bay have agreed to trade veteran quarterback Brett Favre to the New York Jets, the Packers confirmed on their website on Wednesday.

The announcement of the deal brings an end to a drawn out tussle between Favre and the team he served for 16 seasons over his playing status after the 38-year-old made a bid to return to action after announcing his retirement in March.

The NFL reported that in exchange for Favre, the Packers will receive a conditional fourth-round pick at a future draft, rising to the prospect of a first-rounder depending on the amount of games the quarterback plays.

Brett has had a long and storied career in Green Bay, and the Packers owe him a tremendous debt of gratitude for everything he accomplished on the field and for the impact he made in the state, Green Bay said in a statement.

It is with some sadness that we make this announcement, but also with the desire for certainty that will allow us to move the team and organization forward in the most positive way possible.

The NFL's all-time leader in touchdown passes and passing yards , Favre walked away from the sport at the end of last season after leading Green Bay to a 13-3 record and the NFC title game.

'Mindset' issue

However, he had a change of heart after Green Bay decided to entrust the offense to Aaron Rodgers, Favre's understudy for the past three seasons.

The Packers had previously offered Favre a 10-year marketing deal worth more than $20 million to remain in retirement but the three-time league MVP opted to re-launch his career and was reinstated by the NFL on Monday.

He arrived at Packers camp this week and met with coach Mike McCarthy, who concluded that Favre was not in the right mindset to continue playing in Green Bay.

RP may scrap Spratly joint study with China

The Philippine government might scrap altogether its pre-exploration activities for oil and gas in disputed areas in the South China Sea amid allegations that the Joint Marine Seismic Undertaking agreement is unconstitutional and infringes on the countrys sovereignty, MalacaГ±ang said Sunday.
Chief Presidential Legal Counsel Sergio Apostol said the Department of Energy made it known in a meeting at the Palace last week that it was not inclined to continue Phase 2 of the JMSU undertaken by the Philippine National Oil Co.-Exploration Corp. with China National Offshore Oil Co. and Vietnam Oil and Gas Corp. .
Phase 2 of the JMSU was supposed to have begun in October 2007, but it was reportedly put on hold due to legal issues and scandals involving Chinese-funded projects. The JMSU is scheduled to lapse on June 30, but with its second phase unimplemented and unlikely to be continued, the pact would be effectively scrapped.
"We will make a final decision on the matter either Tuesday or Tuesday or this week," Apostol told The STAR in a telephone interview. "The DOE said it is not bent on continuing this."
He said there is no need to get the approval of President Arroyo on the matter since the JMSU was a commercial venture.
He narrated that during the meeting at the Palace, Energy Undersecretary Mariano Salazar said the DOE is not likely to continue the second phase of the JMSU. Apostol, however, could not say why the DOE took such a position.
A PNOC-EC statement in December last year said, "The three companies decision to proceed to the second phase was prompted by the encouraging results of the first phase." The JMSU was forged in March 2005.
Up to now, there has been no detailed report released to the public on the results of the seismic work undertaken by the three national oil companies.
Energy Secretary Angelo Reyes arrived Sunday from the United States and immediately presided a meeting on the issue.
Justice Secretary Raul Gonzalez, for his part, said any move to scrap the JMSU must have the consent of the other parties to the agreement.
He and Apostol also said there is also a possibility that after the JMSU lapses, the PNOC-EC, CNOOC and PetroVietnam can still renegotiate for another agreement, especially if there are commercially-viable quantities of oil and gas.
Gonzalez also said a move to scrap or renegotiate the terms of the JMSU before it lapses is complicated. "We would be involving foreign firms in a domestic hullabaloo if that is really the reason for a renegotiation."
He dismissed calls to bare to the public all the details and results of the JMSU saying "who will trust us in international agreements if we do that."
He said there is also no truth that the JMSU infringed on the countrys sovereignty or weakened the Philippines claim over some areas in the South China Sea.
Gonzalez pointed out that it was clear in the JMSU that it will not weaken the respective claims of the Philippines, China and Vietnam and the agreement also "respects the United Nations Convention on the Laws of the Sea ."
"If it will weaken our claim then it will weaken their claims also," he said.
Gonzalez said it was not also true that the JMSU also affected other claimants to the Spratlys. He said if that were true, the other claimants should have raised a howl several years ago when the agreement was still being hammered out.
"There are no issues here, only the ones being created by their imagination," he said.
"These activities are all pre-exploratory, if we talk about exploration and exploitation of natural resources, then the constitutional provision of 60 percent Filipino ownership should be applied," Apostol said.
Meanwhile, former energy secretary Vicente Perez and former PNOC head Eduardo MaГ±alac defended the JMSU saying the PNOC "was extremely careful and consistent in ensuring the constitutionality" of the pact.
"The JMSU is a commercial agreement between three national oil companies to jointly acquire seismic data. No exploration, drilling, and production activities were covered by the agreement. The JMSU is simply a data gathering effort among the three oil companies. The JMSU is not a treaty. If at the end of the three-year term of the JMSU, no new definitive agreements are agreed on, then the JMSU expires by June 2008," their joint statement said.
"The President did not sign the JMSU, nor did the Department of Energy. However, the approval of the respective governments of the three oil companies was required to make the commercial agreement binding. The JMSU explicitly stated that the signing of the commercial agreement shall not undermine the position held by the Philippine Government over the South China Sea. The agreement is designed to be scientific in nature and does not affect any territorial claims of the Philippine government."
Strong and vibrant relationship
In another related development, the US Embassy in Manila denied rumors of a possible rift between the Philippines and the United States and said the relationship between the two countries remains "vibrant" amid the controversial "Spratlys deal" that the Philippines signed with China and Vietnam.
"As Ambassador Kenney said, the US-RP relationship remains strong and vibrant," Karen Schinnerer, acting spokesperson for the US Embassy in Manila, told The STAR.
The US Embassys statement came in reaction to news reports quoting former Senate president Franklin Drilon as saying that Philippine Ambassador to Japan Domingo Siazon Jr. had told him that the signing of the JMSU displeased the US.
Drilon claimed Siazon had revealed that Washington was "pissed off" by the Philippines warming up to China as shown by agreements between the two countries, including the exploration work in the disputed Spratly Islands.
But Schinnerer said the resolution on the rightful claimants to the disputed group of islands would depend on the countries involved.
"The issue of the Spratlys has to be resolved among the countries that have claims," she said. "We hope it will be resolved peacefully and transparently."
Siazon, a former foreign affairs secretary, has said that it was unlikely that he had used the words "pissed off" in his conversations with Drilon.
MalacaГ±ang has also declared its openness to any investigation into the agreement but expressed concern over its motive.
Quo vadis, Drilon?
Meanwhile, pro-administration Sen. Miriam Defensor Santiago criticized Drilon Sunday for saying that President Arroyo may be impeached for allowing the JSMU between China and the Philippines when he had issued a 1990 opinion stating that a similar offshore project with Australia was legally feasible.
"Drilon in 1990 said that a seismic project with Australia was legally feasible. Now Drilon in 2008 is saying that a similar seismic project with China could be a legal basis for impeaching President Arroyo. He will have to explain his mental calisthenics before the committee," the senator said.
The senator noted that Drilon, in his opinion, has declared that "the project proposal which involves data-gathering, processing, and interpretation techniques envisioned pre-exploration activities which are not covered by constitutional limitations."
Earlier, Drilon debunked Secretary Gonzalezs claims that he issued a legal opinion favoring the joint exploration agreement with China in the disputed Spratly Islands.
The former Senate president said Gonzalez erred in insisting the legal opinion he made was in view of the JMSU between China and the Philippines.
Drilon said his opinion was issued in connection with another area, "definitely not the Spratlys."
"I am afraid Justice Secretary Gonzalez is intellectually dishonest if he claims that I am contradicting myself," Drilon said in an interview last Saturday while en route to Australia for a speaking engagement before a Filipino community.
But Santiago, a lawyer, argued that Drilons flip-flop shows his intellectual inconsistency.
"In 1990, Drilon approved not only the seismic project, but even a service contract with a foreign country for the use of petroleum resources. By contrast, in 2008, Drilon implies that a similar seismic project, without a service contract is already illegal and exposes the President to impeachment. This is a flip-flop that shows intellectual inconsistency," she said.

RCBC massacre suspect yields

A suspect in the bloody heist at the Rizal Commercial Banking Corporation branch in Cabuyao, Laguna in May surrendered to the Commission on Human Rights on Tuesday.
Jake Javier, son of slain suspect Vivencio Javier, said he went to the CHR to clear his name after police alleged that he was involved in the bank massacre.
Ten people were killed during the May 16 heist at the RCBC branch.
Javier said he was at home sleeping when the robbery happened. He went hiding after learning that the police's Task Force RCBC launched a manhunt against him.
He said he was not able to pay his last respects to his slain father because he had to go into hiding.
The young Javier was among the 11 people charged by the police with multiple homicide and robbery for the bloody heist.
Charged for the bloody heist were Pepito Magsino, Montano Tolentino, Eugenio Hilardio, Jun Alvarez, Crisanto Alvarez, Joel de la Cruz, Jesus Narvaez, Ricardo Gomolon, Allan Bago and Danilo Letoquit.
Javiers father, a former village chief, along with Rolly Lachica, and Angelito Malabanan, of Tanauan City, Batangas were killed in a police operation.
Magsino and Tolentino, meanwhile, were also slain by policemen in supposed shootouts.
The CHR had said that the two could have been victims of summary executions as initial forensic examination showed there were no traces of evidence at the crime site that would prove there was a shootout.

A spokesman of the Sulpicio Lines said Friday that the shipping company did not bother checking the 10-metric ton chemical equipment because it was cleared by the Bureau of Customs .
"This item was already cleared by the Bureau of Customs," lawyer Manuel Espina, legal counsel and spokesman of the Sulpicio Lines, told radio dzMM.
Espina added that the document from the BOC did not say the shipment was toxic. He said the clearance document said the container van was carrying "Endosulfan, technical."
The lawyer explained that the Sulpicio Lines could not have checked the contents of the container van because it was supposed to be unsealed by the shipper upon arrival at the Cebu port.
"The shipment was placed inside the container van by the shipper... sealed by the shipper. Only the shipper can open it at the point of destination," he said.
The government on Friday ordered salvage divers to halt retrieval operations at the sunken Sulpicio Lines passenger vessel because of the presence of 400 cartons of Endosulfan, which Health Secretary Francisco Duque, said can be hazardous, or worse fatal, for a person.
"Endosulfan is a restricted pesticide for use in pineapple plantations. At toxic levels and following ingestion it can cause death or affect the central nervous system, manifesting as headaches, dizziness, nausea, tremors, convulsions which may also include cardiovascular symptoms," Duque explained.
Transportation and Communications Undersecretary Elena Bautista said the inter-agency task force overseeing the operations for the sea tragedy will look into the possible sanctions that can be imposed on Sulpicio Lines for keeping the shipment secret from the Philippine Coast Guard.
"We are looking into that because they did not coordinate with the Philippine Coast Guard. They should have asked permission from the Coast Guard," Bautista told radio dzMM.
Switched
The Del Monte Philippines, Inc. blamed Sulpicio Lines however for loading the chemical shipment to the M/V Princess of the Stars.
The DMPI said in a statement that the Endosulfan cargo was supposed to be loaded to the M/V Princess of the Paradise, not the ill-fated vessel.
"Without the knowledge and consent of DMPI, Sulpicio Lines loaded the Endosulfan cargo in the M/V Princess of the Stars instead of the M/V Princess of the Paradise which was supposed to the appointed vessel for this cargo," said DMPI in a statement.
However, a check with the Sulpicio Lines Web site said the Princess of the Paradise is also a passenger ferry.
Bautista had explained that it is prohibited to load hazardous chemicals on passenger vessels. She said chemicals such as endosulfan should be loaded on a cargo vessel.
Before a cargo vessel sails off with such a chemical, it should have a stowage plan clearance from the Philippine Ports Authority, she said.
The DMPI said the "Sulpicio Lines was fully apprised of the nature of the cargo as all documents were furnished to them including the material safety data sheet from the supplier."
It added that the chemical came from a supplier from Israel "and it was packed and shipped in accordance with strict international shipping standards.'
Sulpicio kept it secret
Bautista said they learned about the chemical shipment on the sunken ferry from Del Monte Philippines.
She said Del Monte sent a letter to the Department of Agricultures Fertilizer and Pesticide Authority on June 24 advising that the sunken ferry is loaded with 400 cartons of the pesticide.
In another letter sent June 25, Del Monte reminded Sulpicio Lines about the hazardous shipment.
She said Sulpicio management did not inform the PCG about the shipment even after receiving the letter from Del Monte.
Bautista said the Department of Transportation and Communications was informed of the dangerous shipment Thursday afternoon.
PCG may not be liable
Bautista, meanwhile, clarified that the PCG doesnt have a way of knowing what was inside the container van even if the M/V Princess of the Stars was inspected.
"The shipment was containerized. We dont have container scanners," she said.
She added that the PCG only does random checks, and that it cannot physically search all the contents of ships.

"We wont know the load if its not declared by the shipper," she said.
Safety first
Bautista said divers at the sunken ship have been grounded and advised not to dip into the sea.
She said special diving equipment from Singapore will arrive on Friday and a team of expert divers will be transported to the site of the ferry vessels wreckage on Saturday.
The official said a barge with a crane will also be sent on Friday to the site, which will be used to retrieve the chemicals.
"As of now, wala pa pong contamination ang tubig. Its a perfect time to get the cargo out as soon as possible," she said.
She said the experts will dive into the sunken ship and assess which part of the ship should be sliced.
After the ship has been breached, the divers will attach the crane to the container van and pull out the cargo.
Bautista said they are not sure if the pesticide cargo was properly secured inside the container van. What the officials know is that the plastic bags were bound by wires.

An Arroyo political ally, former Commission on Elections chairman Benjamin Abalos, was accused of seeking $130 million in kickbacks for himself and the President's husband on the ZTE deal. President Arroyo canceled the contract after the scandal broke and ordered a formal inquiry. The scandal has hurt Arroyo's standing, with opposition groups mounting growing street protests calling for her to quit. In a speech before government employees Tuesday, President Arroyo criticized the opposition for using the ZTE issue to advance their political ambitions. Counter-affidavit During the resumption of the hearing on Tuesday, Mr. Arroyo filed a 20-page counter-affidavit in the case filed by former vice president Teofisto Guingona Jr. In his counter-affidavit, Arroyo maintained his innocence, saying that he has avoided being involved in any government transaction since his wife became President in 2001. He added that he only learned about the NBN deal through media reports and some documents shown to him. He also said it would be impossible to influence the Chinese government to appoint ZTE as the prime contractor in the broadband deal. De Venecia, whose Amsterdam Holdings Inc. submitted a proposal for the NBN project, earlier said Mr. Arroyo had told him to "back off" from the deal. Tension Tension flared up among legal counsels after the investigating panel вЂњin the interest of justiceвЂќ granted Abalos camp a five-day extension to file their counter-affidavit regarding the case filed by Hontiveros-Baraquel. Lawyer Ibarra Gutierrez III, Hontiveros-Baraquels lawyer, manifested that the 10-day period wherein which Abalos was expected to file his counter-affidavit had already lapsed on February 28. Lawyer Gabriel Villareal, Abaloss legal counsel, said, he had been trying to secure transcripts of the Senate hearings on the NBN deal, which were cited in Baraquel's complaint. вЂњI was not able to obtain those copies as of yesterday so that this morning , I filed a motion for my client to be given additional time to file his counter-affidavit in this case. I made the same motion in the Guingona case," he said. On the Guingona case, Villareal argued that the complaint was вЂњ not complete.вЂќ Villareal added that his client would file his counter-affidavit вЂњpreferablyвЂќ after they have reviewed the evidence presented by the complainants. The move was opposed by Gutierrez and Roque. Roque said Abalos had already waived his right to file his response to the charges after failing to submit his counter-affidavit on Tuesday. Roque also pointed to the non-extendible period of 10 days in filing the counter-affidavit as provided for by the Ombudsmans rules. Meanwhile, Roque also asked the Ombudsman to compel the President to submit her counter-affidavit. The panel gave him three days to make his request in writing and submit this before the panel for deliberations.
